Mumbai: Inorbit mall and star hotel in Vashi illegal, must go, rules HC

Mumbai, Nov 23, 2014: The Bombay high court on November 22, said the City and Industrial Development Corporation (Cidco) had "irregularly allotted" 31,000sq m of land in Vashi, on which the Inorbit Mall and the Four Points hotel stand, to K Raheja Corp and directed the developer to "hand back vacant possession" of the land to the planning agency in six months.

inorbitThe bench of Justices Abhay Oak and A S Gadkari said the developer could, during this period, apply to Cidco for regularization.

Cidco had, however, issued a showcause notice to the developer earlier this month asking why the allotment should not be cancelled. The state-appointed D K Sankaran panel that probed the matter had also said in its report in 2005 that the allotment should be cancelled.

Calling the lease agreement between Cidco and the developer illegal and directing that the land be "restored", the court rejected the developer’s plea to stay the order for 12 weeks. It said that since it has given six months’ time to hand over "vacant possession", the developer could use that time to go in appeal. No third-party interest should be created during this period, the court stated.
