In jail for 17 months, Mumbai man gets bail as DNA shows he didn’t father of neighbour’s child

Mumbai, Jan 25, 2021:      A restaurant worker, who was arrested for allegedly raping and impregnating his neighbour, was granted bail after the DNA paternity test revealed that he was not the biological father of the girl’s fetus.

The 25-year-old man had been in jail for 17 months but the court granted him bail after the DNA report negated that he was the father of the child.

After going through the report and arguments from both sides, the court granted the man bail while stating, "It will take time to decide the matter on merits. Looking at the DNA report, his prayer needs to be allowed."

THE CASE SO FAR

A deaf and mute victim, studying at a special child school, had complained of stomachache while she was in school on July 23, 2019. The family had taken the girl to the hospital only to find that she was pregnant.

When the girl was confronted, she told the family that the neighbour had raped her on two occasions. Mumbai Police had conducted the investigation and filed a chargesheet.

The accused had filed a plea for bail earlier but it was rejected as the investigation was still underway. However, with the DNA report in his favour, the accused filed another bail application stating that he was falsely implicated in the case.

The prosecution strongly opposed the plea stating that if the accused is granted bail, there was a possibility that the accused will tamper with the prosecution’s evidence. The court, however, granted bail to the man after the DNA report proved he did not father the girl’s child.
