Mumbai drugs case: No bail for Aryan Khan, Bombay High Court to resume hearing tomorrow

Mumbai, Oct 27, 2021: In a repeat of the previous day, the Bombay High Court on Wednesday again adjourned the hearing of Bollywood superstar Shah Rukh Khan’s son Aryan’s bail plea in the Mumbai drugs seizure case.

A single-judge bench of Justice Nitin W Sambre of the Bombay High Court is hearing the bail pleas of Aryan Khan, Arbaaz Merchantt and Munmum Dhamecha. The court will resume the hearing on their bail pleas at 2.30 pm on Thursday.

Incidentally, the Diwali vacation for Bombay High Court begins from November 1 and will continue till November 12. The court will also remain closed on November 13 and 14 as it is a Saturday and Sunday. If Aryan Khan does not get bail on Thursday and Friday, he will have to stay in jail till November 15.

Aryan Khan, 23, was arrested on October 3 along with several others during a raid by the Narcotics Control Bureau (NCB) on Cordelia Cruises’ Empress ship off the Mumbai coast. His bail application was earlier rejected by both the magistrate court and the special NDPS court.

During the hearing in the high court today, Arbaaz Merchantt’s lawyer Amit Desai said that the arrests of Aryan, Arbaaz and Munmum were illegal. "We [Aryan, Arbaaz] can be put under strict conditions but we cannot be behind bars when the punishment for the offence is only one year. There are circumstances that show that there is no conspiracy," he argued.

Former Attorney General Mukul Rohatgi, appearing for Aryan Khan, added, "The law requires that you must give true and correct ground for arrest."

Amit Desai said that there was no connection between the WhatsApp chats and the case. "There is no connection. No WhatsApp messages, no calls between the accused," he argued.

"If the remand is seen, there is absolutely no link between the two. While they are keeping us all [Aryan, Arbaaz and Munmum] in jail for WhatsApp chats."

Desai went on to say that the WhatsApp chats cited by NCB’s lawyers are "very old" and have no connection to the incident.
