SC cancels bail of Ashish Misra in Lakhimpur violence case, asks him to surrender in a week

New Delhi, April 18, 2022: The Supreme Court canceled Lakhimpur Kheri violence accused Ashish Misra’s bail and ordered him to surrender within one week. During a hearing on Monday, the court set aside the Allahabad High Court order granting Ashish Misra bail and said, "The high court exceeded its jurisdiction, denied victims their right to participate in proceedings."

 

"The high court has taken into consideration several irrelevant considerations and issues. No legal necessity to give undue advantage to the FIR," the Supreme Court said in its order.

Ashish Misra, son of Union minister Ajay Misra, is a key accused in the case pertaining to the violence that erupted in Uttar Pradesh’s Lakhimpur Kheri region in October last year. He was arrested on October 9 and granted bail in February this year.

Eight people, including four farmers, died in violence that broke out in Uttar Pradesh’s Lakhimpur Kheri on October 3 ahead of a visit by Deputy Chief Minister Keshav Prasad Maurya.

The violence erupted after a car belonging to Ashish Mishra, son of Minister of State (MoS) for Home Ajay Mishra, allegedly ran over the farmers who were protesting against the Centre’s three farm laws ahead of an event in Tikunia. Four farmers were killed in the incident.

This led to clashes between the protesters and BJP workers, which led to the death of four more people, believed to be from the BJP’s convoy.

While farmers’ outfits alleged that Ashish Misra was inside a car that ran over the four farmers, the Union minister’s son denied the claims.

The Special Investigation Team (SIT) probing the Lakhimpur Kheri violence incident said that there was a planned conspiracy to murder protesting farmers.Earlier, the Lucknow bench of Allahabad High Court granted bail to Ashish Misra. However, the court’s order was overturned by the Supreme Court on Monday.
