Sunny Leone moves Kerala HC to quash FIR in contract breach case

New Delhi, Nov 16, 2022: Actor Sunny Leone has moved the Kerala High Court seeking to quash an FIR filed against her by the crime branch wing of the state police in a cheating case. She is accused of breaching terms of a contract supposedly entered into with a firm for a stage performance in Kozhikode four years ago.

In her plea, the actor rejected the allegations against her, her husband and their employee. She contended that the charges would not constitute the ingredients of the alleged offences. She claimed they were not involved in any crime till date. She said they were put to untold misery, irreparable loss in making them face what she called a long-drawn process of trial when no material or clear evidence against them has been found.

The crime branch is investigating the case that was registered on a complaint from Shiyas Kunjumohammed, an individual, from Ernakulam district.

The complaint filed by Shiyas, the coordinator of the shows, claimed that the actor had entered into a contract with him for performing at stage shows in the state and overseas and was paid Rs 39 lakh for it. He accused Sunny and others of committing a breach of contract by not appearing for the shows and failing to return the money.

Sunny’s husband Daniel Weber and Sunil Rajani, chief executive officer, Suncity media entertainment, Mumbai, have been named as second and third accused respectively in the case. They also sought quashing of the FIR.

The police have registered an FIR (First Information Report) for offences under Sections 406 (criminal breach of trust) and 420 (cheating) of the Indian Penal Code (IPC).
