RK Mishra Cyber Crime in MangaloreMangalore, Oct 7, 2013(DNA): Chain link custody is vital for investigation of cyber crimes which means that links between various steps of procedure must be maintained for cracking the crime in an easier way at the earliest. Elaborating about various procedures for solving cyber crimes, additional director general of police, Cyber Crime RK Mishra gave tips to police officials from around 22 states, para-military forces and army during the ongoing 3rd National Cyber Crime Training Programme at Police Radio Training School on Saturday, Oct 5.

"Computer as a tool, computer as a target and computer as a tool and target both is cyber crime," maintained ADGP Mishra.

During the investigation of cyber crime, place from where the crime was committed, gadgets like mobile phone, computer, laptop, cord, ear phone connector and router used in the crime and mode of communication (wireless or wired) plays a significant role.

Criminals involved in cyber crimes using modern gadgets and advanced technology are normally genius and could be traced only if the investigator is more clever and updated with fast changing technology in the world, asserted Mishra.

Earlier, analogue technology was used to crack conventional crimes but in present scenario, police use digital technology.  For preliminary enquiry after any cyber crime is reported, Section 154 of CrPC empowers enquiry officer to decide whether it was a cognizable offence and under Section 91 of CrPC, police can ask for documents or records required for preliminary enquiry.

The next step is investigation begins after preliminary enquiry is completed and there are leakages and after an FIR was registered about cyber crime. During investigation, pocketing of server, search and seizure is done before putting the evidence in the court.

Under Section 66-B of Information Technology Act, a certificate issued by an expert in the particular field in cracking cyber crime is admissible in the court otherwise case may be quashed at the primary stage of trial.
